Service Agreement

Parties to This Agreement

This Service Agreement is entered into between 2-Nice Rideshare & Carpooling Transport Services Inc., a corporation incorporated under the laws of Manitoba, Canada, operating the platform RideCarpooling.com ("Company", "we", "us", "our"), and any individual or entity that registers for, accesses, or uses the Platform ("User", "you"). By creating an account or using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

Scope of Services

The Company provides ride matching and booking technology, secure payment processing via Stripe and PayPal, identity verification, in-app messaging with privacy protection, real-time GPS tracking, and a rating and review system.

Additional services include driver ride posting and management tools, passenger advance ride search with filters, and 24/7 AI-powered help assistance with live chat support during business hours.

Service Fees & Pricing

Platform Service Fee: 15% of the ride price (drivers keep 85%). Displayed transparently at checkout and non-refundable once a ride is completed.

Driver Payout Schedule: Earnings held for 48 hours after ride completion (dispute protection window). Payouts processed via PayPal or bank account, 3-5 business days. Minimum payout threshold: $25 CAD.

Passenger Pricing: Ride prices set by drivers in Canadian Dollars (CAD). Payment collected at booking. Stripe processing fees included.

Cancellation & Refund Policy

• More than 24 hours before departure: Full refund minus platform service fee
• 12-24 hours before departure: 50% refund
• Less than 12 hours before departure: No refund
• Driver cancellation: Passenger receives full refund. Frequent driver cancellations may result in account restrictions
• Exceptional circumstances: Medical emergencies with documentation, natural disasters, or platform failures = full refund at Company discretion

Liability & Indemnification

The Company is a technology platform and is not liable for accidents, injuries, or property damage occurring during rides; actions or omissions of drivers or passengers; delays, cancellations, or route changes; loss of personal property; or indirect, consequential, or punitive damages.

Drivers are solely responsible for maintaining adequate insurance. The Company does not provide insurance coverage for rides.

Data Usage & Privacy

By using the Platform, you consent to the collection and processing of your personal data as described in our Privacy Policy. We share data between drivers and passengers only as necessary to facilitate bookings — first name and profile photo visible to matched users, phone number shared only after booking confirmation via masked calling.

Agreement Termination

You may terminate this Agreement at any time by deleting your account through Profile Settings. The Company may terminate or suspend your access for material breach, fraudulent activity, repeated safety violations, or failure to maintain required verification documents.

Governing Law & Jurisdiction

This Agreement is governed by the laws of the Province of Manitoba, Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Winnipeg, Manitoba. Dispute resolution process: informal resolution first, then mediation, then litigation. Class action waiver applies.

Amendments & Updates

The Company reserves the right to modify this Agreement with 30 days' notice to active users via email and an updated "Last Updated" date on this page. Continued use constitutes acceptance of changes.
